Terms and Conditions

1. Who we are and how these terms fit together

Vibe Build Live is a group education and coaching program produced and delivered by Funnel Fuse, LLC, an Arizona limited liability company, P.O. Box 465, Benson, AZ 85602 ("Funnel Fuse", "we", "us"). These Vibe Build Live Terms and Conditions ("these Terms") are offer-specific terms. They apply together with the Funnel Fuse Terms of Service, and you agree to both when you enroll.

Where these Terms differ from the Funnel Fuse Terms of Service on a topic, these Terms control for Vibe Build Live. Your included Build Day is governed by the Build Day Terms of Service (Version 2.3), as modified by Section 5 of these Terms. Where the Build Day Terms and these Terms differ on the Build Day bonus, Section 5 controls. Our Privacy Policy explains how we handle your information.

You must be at least 18 years old to enroll. By checking the agreement boxes at checkout and completing your purchase, you confirm that you have read and agree to these Terms, the Funnel Fuse Terms of Service and the Build Day Terms.

2. What you are buying

Enrollment includes the following. Live elements are provided during the program period described in Section 3. Access to pre-recorded content continues as described in Sections 3 and 10.

• The 12-week Vibe Build Live cohort, with a weekly action and a step-by-step checklist through the program
• Weekly live group calls during the program period, including a strategy and ask-me-anything call with Malia Burcham and optional calls with Funnel Fuse coaches
• One private one-on-one Action Plan call with Malia Burcham, about one hour, to map your plan for the next 90 days and your build order
• The Vibe Build Live template archive and framework, with setup courses
• An unlimited funnels license to use the templates, as described in Section 10
• The Vibe Coding Funnel course, updated as the method changes
• The AI course area
• Access to the Scale It Up community, including funnel audits as described in Section 11
• Agency and service provider training
• The complete business training course, including the Blueprint strategy
• The AI Era Business Setup course
• The Build Day bonus, if you qualify under Section 5
• The lead call-back app fast-action bonus, if you qualify under Section 6

Some courses are released over the program period rather than all at once, including the complete business training course and the weekly Vibe Coding Funnel lessons. Release dates are estimates. Values shown on the sales page or in any presentation describe what comparable services or products have sold for. They are not a promise of any result and are not a refund or credit amount.

3. Program period, calls and recordings

The program begins on or around October 5, 2026 and runs for about 12 weeks, with live calls through Christmas 2026. The program period ends December 31, 2026. Live calls are held during the program period only. Access to the pre-recorded course content in the program's course area continues after the program period for as long as we continue to operate that program or course area, as described in Section 10. Live calls are held weekly, except holiday and event weeks. Call days, times, hosts and frequency are set by us and may change. We may add, move or combine calls at our discretion.

Calls are recorded, and recordings are shared with program members. By joining a call you consent to being recorded and to that recording being shared inside the program. If you do not want to appear, keep your camera off and use the chat, or watch the replay. Recordings are provided where available and are not guaranteed for every session.

4. Bonuses and offer deadlines

Bonuses are included only for purchasers who enroll while that bonus is being offered. All deadlines in these Terms are in Arizona time (America/Phoenix), and your eligibility is determined by the time your order is successfully completed in our checkout system. Bonuses are available as described on the order page by their stated deadlines.

Bonuses have no cash value, cannot be transferred, sold or exchanged for money or another service, and are not refundable on their own. If a third-party tool a bonus depends on becomes unavailable, we may provide a reasonably comparable substitute.

5. The Build Day bonus

Members who complete enrollment by Sunday, October 4, 2026 at 11:59 p.m. Arizona time receive one Build Day, a done-for-you build session delivered by Funnel Fuse, at no additional charge. One Build Day is included per enrollment.

• The Build Day is delivered under the Build Day Terms of Service (Version 2.3), including its rules on scope, preparation, scheduling, the Live Session, recording, deliverable ownership, support, no-shows and the replacement-session fee. By enrolling you agree to the Build Day Terms for your Build Day.
• Because the Build Day is included as a bonus, no separate Build Day Fee is charged. The refund, cancellation and Satisfaction Guarantee provisions of the Build Day Terms therefore do not create a separate cash refund for the bonus Build Day. Any refund of your program purchase is handled under Section 8 of these Terms.
• You book your Build Day on our calendar, subject to availability. Your Build Day must be scheduled and held during the program period, ending December 31, 2026, unless we agree in writing to a later date. A Build Day not used by then expires without credit or refund.
• If you are on a payment plan, your payments must be current when your Build Day is scheduled and when it is held.
• Additional Build Days can be purchased separately at the then-current price.

6. The lead call-back app fast-action bonus

Members who complete enrollment by Friday, October 2, 2026 at 11:59 p.m. Arizona time receive 6 months of access to Funnel Fuse's existing lead call-back app.

• The app is built on third-party software (currently Overskill). Its features depend on that platform and may change.
• Your 6 months of access start on the date we provide access to you. After that, continued access is optional at $250 a month. Renewal is optional and starts only if you choose it. We will not charge you for renewal without your agreement.
• You are responsible for how you use the app, including following all laws that apply to calling, texting and emailing your leads, such as consent and do-not-call rules, and for the accuracy of the lead information you collect.
• We need reasonable information from you to set up your access. If you do not provide it within the program period, the bonus may expire.

7. Payment

The program is offered at $2,997 paid in full, or three monthly payments of $1,197. If you choose the payment plan, you authorize us to charge your payment method automatically each month until the plan is complete. You remain responsible for the full plan amount once enrolled, except as stated in Section 8.

Third-party financing such as Klarna may appear at checkout where available. Approval, terms and repayment for those options are between you and that provider, and we are not a party to that agreement.

If a payment fails or is declined, we may pause your access, including calls, community, materials and any unscheduled or undelivered bonuses, until your account is brought current. Please keep your payment information up to date.

8. 30-day make-it-right guarantee and refunds

We believe in this program, so we offer a 30-day make-it-right guarantee. To use it, within 30 days of the program start date (or of your enrollment, if you enroll after the start date) you must have:

• attended the drop-in calls held during that period, and
• gone through the core training released during that period,

and then tell us in writing at support@funnelfuse.com, within that 30-day period, what is not working for you.

If you qualify, we will work with you to make it right. That may include extra support, more time on a call with Malia or the team, a revised build plan, or another remedy suited to the situation. A refund is one possible remedy. Refund requests are read by a person and decided case by case, at our discretion. Requests outside the 30-day period, or from members who did not meet the conditions above, are not eligible under this guarantee.

If we approve a refund after your Build Day bonus has been delivered to you, we may deduct the then-current published standalone price of that delivered Build Day from the refund. No separate deduction is made for the lead call-back app bonus, and your access to the app ends when a refund is issued. Your access to the program, materials and community ends when a refund is issued, and the unlimited funnels license in Section 10 ends for any template not already used in a live funnel.

If you are on a payment plan, a refund request does not cancel remaining scheduled payments unless we agree in writing. We initiate an approved refund within 10 business days of confirming eligibility. How long it takes to reach you depends on your bank or payment provider.

9. Chargebacks

If you have a billing concern, contact us at support@funnelfuse.com before contacting your bank or card issuer, so we have the chance to resolve it. If a chargeback is filed, we may pause or end your access while it is open, and we may respond to it with records of your enrollment, your agreement to these Terms, and the services and bonuses delivered to you.

10. Intellectual property and unlimited funnels license

All templates, frameworks, prompts, skills, courses, recordings and written materials remain the intellectual property of Funnel Fuse, LLC. You receive a limited, non-exclusive, non-transferable license to use them to build as many funnels and systems as you want, for your own business and for your own clients. Funnels you build for clients may stay live for those clients.

You may not resell, license, republish, give away or share the templates, courses or materials themselves as a product, template pack or course, whether free or paid. You may not share your login, grant access to another person, or reproduce the archive or courses in whole or in substantial part. Breach of this section ends your license and access without refund.

"Lifetime" or "yours forever" access to the template archive or to pre-recorded course content means for as long as Funnel Fuse continues to operate the archive or the program's course area. It does not oblige us to keep hosting or updating it indefinitely. If we move the archive to a subscription, members of this cohort keep access without one.

Build Day deliverables are governed by the ownership terms in the Build Day Terms.

11. Community and funnel audits

Scale It Up includes funnel audits from our team on work you post, with no fixed cap. Audits are strategy feedback given in the community, not a full rebuild, and are subject to reasonable use. Response times are not guaranteed and depend on volume.

12. Your responsibilities

• Maintaining your own ClickFunnels account and any other tools you choose to use. A ClickFunnels subscription is not included in the program price
• Following all laws that apply to your own marketing, including advertising, email, SMS, calling and privacy laws
• Making sure your own offers, claims and testimonials are truthful and backed up
• Backing up your own work and keeping access to your own accounts
• Showing up. The program is participatory, and what you get out of it depends on your effort

13. No guarantee of results

This is an education and coaching program. We do not guarantee any financial, business or marketing result, and nothing in the program, the sales page or any presentation is a promise of income. Outcomes depend on factors outside our control, including your offer, your market, your traffic, your pricing and the work you put in. Results vary. See our Disclosures and FTC Compliance page.

14. Conduct and removal

The community and the calls are shared spaces. We may remove any member, without refund, for harassment, abuse, sharing program materials, soliciting other members without permission, or conduct that materially disrupts the program for others.

15. AI tools and third-party platforms

The program relies on third-party platforms, including ClickFunnels, Skool, Overskill and AI tools such as Claude and ChatGPT. We do not control their availability, pricing, features or terms, and changes to them are not grounds for a refund. Content generated by AI tools can be wrong, so review anything you publish. Our use of AI tools does not limit our responsibility for our own obligations under these Terms.

16. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or relating to the program is limited to the amount you paid us for it. We are not liable for indirect, incidental, consequential, special or punitive damages, including lost profits or lost business opportunity, even if advised of the possibility.

17. Indemnity

You agree to indemnify and hold harmless Funnel Fuse, LLC and its members, employees and contractors from claims arising out of your use of the materials, your marketing, your products and services, or your breach of these Terms.

18. Disputes and governing law

These Terms are governed by the laws of the State of Arizona. Any dispute is resolved under the dispute resolution process in the Funnel Fuse Terms of Service: written notice and 30 days to resolve informally, then good-faith mediation, then binding arbitration administered by the American Arbitration Association, seated in Cochise County, Arizona, with the exceptions and class-action waiver described there.

19. Changes

We may update these Terms. The version in force when you completed your purchase governs your enrollment, except where a change is required by law. Changes are posted on this page with a new version number and date.
